Welcome to the website of Multi-Phase Projects ("Multi-Phase," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of our website located at multiphaseprojects.ca (the "Site"), including any content, functionality, and services offered on or through the Site.

By accessing, browsing, or using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you must not access or use the Site.

1. Scope of Use & Eligibility

This Site is intended strictly for business-to-business (B2B) purposes and is directed to corporate clients, contractors, and job seekers. By using this Site, you represent and warrant that you are of legal age to form a binding contract and possess the authority to bind any company or entity you represent.

2. Website Content & No Professional Advice

The information, materials, and descriptions of our services — including engineering, EPCM (Engineering, Procurement, and Construction Management), project controls, construction, commissioning, and asset lifecycle support — are provided solely for general informational purposes.

The Site's content does not constitute engineering, technical, legal, financial, or other professional advice. You should not act or rely on any information on the Site without seeking professional counsel.

The presentation of services or projects on this Site does not constitute a binding offer or contract. Any engagement of Multi-Phase Projects to perform professional services is governed exclusively by a separate, written, and signed services agreement (such as a Master Services Agreement) between Multi-Phase Projects and the client.

3. Workforce Portal & Accounts

Our Site links to the Multi-Phase Workforce Portal (portal.multiphaseprojects.ca) for job applicant registration, workforce profiles, and employer portal services.

  • Portal Terms: Access to and use of the Workforce Portal is subject to additional registration terms, profile validation procedures, and portal-specific terms of use.
  • Account Security: If you receive access to the Workforce Portal, you are responsible for maintaining the confidentiality of your credentials and restricting unauthorized access to your account. You agree to notify us immediately of any security breach or unauthorized use.

4. Intellectual Property Rights

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, design, logos, and layout) are owned by Multi-Phase Projects, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your internal business evaluation purposes. 8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MULTI-PHASE PROJECTS, ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, OR ANY CONTENT ON THE SITE, EVEN IF FORESEEABLE.

9. Indemnification

You agree to defend, indemnify, and hold harmless Multi-Phase Projects, its affiliates, licensors, and service providers, and their respective officers, directors, employees, and contractors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your misuse of the Site.

10. Governing Law & Jurisdiction

All matters relating to the Site and these Terms, and any dispute or claim arising therefrom, shall be governed by and construed in accordance with the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the courts of the Province of Saskatchewan, located in Regina, and you consent to the personal jurisdiction of such courts.

11. Severability & Entire Agreement

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions of the Terms will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the sole and entire agreement between you and Multi-Phase Projects regarding the Site and supersede all prior understandings or agreements, written or oral, regarding the Site.
